These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Red Moon Pits (“we,” “us” or “our”), concerning your access to and use of the Solitaire RMP mobile application (the "Application").
By downloading, installing, or interacting with the Application, you explicitly acknowledge that you have read, understood, and irrevocably agree to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, you are expressly prohibited from using the Application and must delete it immediately.
IMPORTANT DISCLAIMER: THIS AGREEMENT CONTAINS STRICT LIMITATIONS OF LIABILITY, AN ABSOLUTE WAIVER OF CLASS ACTION RIGHTS, AND COMPREHENSIVE INDEMNIFICATION CLAUSES DESIGNED TO PROTECT RED MOON PITS TO THE MAXIMUM EXTENT PERMITTED BY LAW.
1. Intellectual Property Ownership & Restrictions
Unless otherwise indicated, the Application, including its source code, object code, databases, software architectures, graphics, UI/UX designs, audio layers, and trademarks (the “Content”) are the exclusive property of Red Moon Pits and are protected by international copyright, trademark, and unfair competition laws. You are granted a limited, non-transferable, revocable license to use the app strictly for personal, non-commercial entertainment. You shall not:
- Decompile, reverse engineer, disassemble, decrypt, or attempt to derive the source code of the Application.
- Modify, adapt, improve, enhance, translate, or create derivative versions of any part of the Content.
2. Complete Disclaimer of Warranties (As-Is Basis)
The Application is delivered to you on an "AS-IS" and "AS-AVAILABLE" basis. To the maximum extent permitted by applicable law, Red Moon Pits disclaims all warranties, express or implied, including merchantability, fitness for a specific purpose, and non-infringement. We do not guarantee that the Application will be error-free, uninterrupted, secure, or free from server delivery anomalies, performance latency, bugs, or data loss.
3. Absolute Limitation of Liability
In no event shall Red Moon Pits, its directors, developers, or affiliates be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, loss of data, hardware malfunction, or system failures arising from your use of the Application. Your sole and exclusive remedy for dissatisfaction with the Application is to stop using it and uninstall it from your device.
4. Technical Environment & User Responsibilities
The operational state of Solitaire RMP depends on external factors beyond our control. You explicitly accept full liability and financial responsibility for:
- Network & Carrier Fees: Any data consumption, cellular roaming fees, or Wi-Fi provider costs generated through normal application procedures, background ad loading, or software binary updates.
- Hardware Safeguards: Ensuring your mobile device retains adequate battery capacity. We reject any liability if gameplay data is interrupted due to terminal power loss.
- System Disruption (Rooting/Jailbreaking): Modifying your device's native operating framework voids all operational claims. We hold zero liability for app errors resulting from custom ROM installations, root access elevation, or malicious software present on your operating platform.
5. Third-Party Integrations & Platform Ecosystems
The Application incorporates verified third-party Software Development Kits (SDKs) to execute advertisement serving pipelines and performance debugging. By playing, you acknowledge adherence to the terms implemented by these external partners:
- Google Play Services (Terms)
- AdMob Advertising Ecosystem (Terms)
- Firebase & Crashlytics Infrastructure (Terms)
6. Right of Termination and Modification
Red Moon Pits maintains the absolute, non-negotiable right to modify, adjust, patch, or suspend the Application, or any content within it, at any time, for any reason, and without prior notification or liability to you. Furthermore, we reserve the right to permanently terminate the availability of the Application and cancel your access license instantaneously without notice.
7. Governing Law and Dispute Resolution
These Terms and Conditions and your relationship with the Application shall be governed by and construed in accordance with local legislation, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of this agreement shall be instituted exclusively in competent judicial courts. You hereby waive any objection to the exercise of jurisdiction by such courts.
